Is it just me, or is Wizards of Waverly Place copying Harry Potter?

Ok, the ball game that they play in Wizards of Waverly Place, when they hit the "tattler" its an automatic win! In Harry Potter, the y get the "snitch" And Dumbledor looks exactly like the headmaster in Wizards. It is sickening! There are so many comparisons. Does anybody feel the same way?! If you do, tell me some other things.
